Legal basis for data management

The legal basis for data processing is your consent in accordance with Article 6 (1) (a) of the GDPR.

The DKA and the data processor (s) will treat the personal data provided by the User as confidential and comply with the relevant data protection legislation. In the interest of secure data management, DKA takes and ensures all measures promoting IT and other secure data management related to data storage, processing and data transmission.

 

The DKA shall take the necessary measures to ensure the protection of the personal data processed by it against unauthorized access, alteration, disclosure, deletion, damage or destruction, in order to guarantee the necessary technical conditions.

 

Users have the following rights in relation to data management

Access right

The User has the right to be informed whether the processing of his / her personal data is in progress, if so, the right to have access to the personal data and the following information:

  1. the purposes of data management;

  2. categories of the User's personal data;

  3. the recipients or categories of recipients to whom the personal data have been or will be communicated, including in particular third country recipients or international organizations;

  4. where applicable, the intended period for which the personal data will be stored or, if that is not possible, the criteria for determining that period;

  5. the right to request the DKA to rectify, delete or restrict the processing of personal data concerning him or her and to object to the processing of such personal data;

  6. the right to lodge a complaint with a supervisory authority;

  7. if the data was not collected from the User, all available information about their source;

  8. the fact of automated decision-making, including profiling, and at least in such cases, understandable information about the logic used and the significance of such data management and the expected consequences for the User.

 

Right of rectification

The User is entitled to request the correction or supplementation of inaccurate personal data, which DKA is obliged to comply with without undue delay.

 

Right of cancellation

At the request of the User, if its legal conditions exist, DKA is obliged to delete the personal data concerning the User without undue delay, if

  • personal data are no longer required for the purpose for which they were collected or otherwise processed;

  • if the personal data is processed for the direct acquisition of business and the User objects to the data processing and there is no priority legitimate reason for the data processing;

  • personal data have been processed unlawfully; obsession

  • personal data must be deleted in order to comply with a legal obligation under EU or Member State law applicable to the DCO.

 

We emphasize that the rules on the right of cancellation do not apply if the processing is necessary: to fulfill an obligation under EU or Member State law to process personal data, or to bring, enforce or defend legal claims.

 

Right to restrict

At the request of the User, DKA is obliged to restrict data processing if

  • the User disputes the accuracy of the personal data, in which case the restriction applies to the period of time that allows the DKA to verify the accuracy of the personal data;

  • the data processing is illegal and the User objects to the deletion of the data and instead requests a restriction on their use;

  • DKA no longer needs personal data for data processing purposes, but the User requests them to submit, enforce or protect legal claims; obsession

  • if the processing of personal data is for the direct acquisition of business and the User objects to the processing of data; in this case, the restriction applies for the period until it is determined whether the legitimate reasons of the DKA take precedence over the legitimate reasons of the User.

 

If the processing is subject to restrictions as set out above, such personal data may be removed from storage only with the consent of the User or for the purpose of making, enforcing or protecting legal claims or protecting the rights of another natural or legal person or in the important public interest of the Union or a Member State. can be treated. The DKA shall inform the User, at whose request the data processing has been restricted, in advance of the lifting of the data processing restriction.

By submitting a complaint (complaint) to the supervisory authority, the User may initiate an investigation on the grounds that he or she has been infringed or is in imminent danger in connection with the processing of his or her personal data. In case of illegal data processing experienced by the User, he may initiate a civil lawsuit in court.  The court has jurisdiction to hear the case. The lawsuit - at the option of the User - may also be initiated before the court of the place of residence.
